Registration Process

It emphasizes the importance of the trademark's distinctiveness, checking its availability in national databases, and that protection is valid only in the country where it is registered.

It also provides details about the application process, whether online or on paper, and highlights the potential for misleading invoices related to fees.

1. Preliminary Search & Consultancy

  • We check the trademark's availability by consulting the relevant registers.
  • We identify potential conflicts and provide recommendations for any necessary adjustments.

2. Defining Classes of Services/Products

  • We establish the scope of the trademark, defining what is intended to be protected by the trademark.

3. Filing the Application

  • Completing the application online, with one or more individuals or legal entities as the applicant.
  • Payment of fees.

4. Preliminary Examination by the Office

  • If there are any deficiencies, they can be addressed by the applicant.

5. Publication of the registration application in the "Buletinul Oficial"

6. Examination of the application by the office

7. Approval decision (published in "Buletinul Oficial")

  • Dacă decizia de admitere este parțială sau respinsă, solicitantul poate formula contestație.

8. Opposition Period

  • Oppositions can be filed within 2 months (for national trademarks) from the publication of the approval decision.
  • Oppositions can be filed within 3 months (for European trademarks) from the publication of the approval decision.

Publication of the trademark in "Buletinul Oficial" and issuance of the Trademark Registration Certificate

  • If there are no oppositions or if oppositions have been dismissed/withdrawn.

10. Monitorizare (recomandat cel puțin lunar) & Reînnoire (10 ani)
