What is a patent?
A patent is an industrial property title that grants the holder the exclusive right to commercially exploit the invention for a limited period, usually 20 years. This exclusive right stimulates innovation and investment in the development of new technologies.
Registration procedure
1. Filing the Application
Completing and filing the patent application with OSIM, which must include a summary of the invention, a detailed description, claims, and, if necessary, explanatory drawings.
2. Preliminary examination
- OSIM conducts a preliminary examination to verify whether the application meets formal requirements and if the invention is clearly described.
3. Publication of the application
- After 18 months from the filing date or the claimed priority date, the patent application is published.
4. Substantive examination
- A detailed analysis to determine if the invention is novel, involves an inventive step, and is capable of industrial application. This stage is crucial for validating the application.
5. Issuance of the patent
If the application successfully passes the substantive examination, OSIM issues the patent, granting the holder exclusive rights to the invention.
