Utility models

Utility models protect technical innovations with a practical and industrial character. They are similar to patents but are easier to obtain and less costly.

For the difference between utility models and patents, consult the frequently asked questions.

Registration procedure

1. Checking the conditions

  • Novelty: The innovation must be new and not known from the prior art.
  • Industrial applicability: The innovation must be applicable in industry.
  • Technical character: It must be a product (device, equipment) and not a process or method.

2. Preparing and filing the documentation

  • Description of the innovation: A detailed description of the innovation is required, including technical drawings if applicable.
  • Filing the application with OSIM and payment of fees.

3. Evaluation of the application

  • Documentation report: OSIM will prepare a documentation report to verify the novelty of the innovation.
  • Registration: The utility model is registered at the applicant's responsibility, without a detailed technical examination.

4. Production and commercialization

  • Duration of protection: The protection is valid for 6 years, with the possibility of extension up to a maximum of 10 years.
  • Commercial exploitation: After registration, production and commercialization of the protected product can begin.

Advantages (compared to patents):

  • Speed: The registration procedure is faster than that for patents.
  • Reduced Costs: Fees and maintenance costs are lower.
