Required Documents for Trademark Registration

  1. Trademark Registration Application must include:

    • The explicit request for trademark registration.
    • Identification details of the applicant and, if applicable, the representative.
    • A representation of the trademark that allows the products or services to be distinguished from those of other enterprises.
    • The list of products and/or services for which trademark protection is requested.
    • Proof of payment of the filing and publication fees.
  2. Additional elements:

    • The color or colors claimed as a distinctive element of the trademark.
    • The type of trademark (three-dimensional, figurative, verbal, etc.).
    • Transliteration or translation of the trademark if it contains foreign characters or words.

Filing the Application with OSIM

Trademark registration applications can be submitted by:

  • Directly to the OSIM General Registry.
  • By mail, with acknowledgment of receipt.
  • Online, on the OSIM website.

Procedure for Processing the Application

  1. Examination Fee: Must be paid within 30 days of submitting the application, otherwise the request will be rejected.
  2. Application Review: OSIM examines the application within 7 days. If additional information is required, it must be provided within 30 days.
  3. Publication of the Application: After the application is approved, it will be published online within 7 days.
  4. Public Observations: Within 2 months of publication, any interested party may submit observations regarding the application.
  5. Substantive Examination: OSIM decides within 6 months whether to approve or reject the registration application.
  6. Publication of the Registered Trademark: If the application is approved, the trademark is published in the Official Industrial Property Bulletin.

Validity and Renewal of Trademarks

Registered trademarks are valid for 10 years. Renewal can be requested at least 6 months before expiration.

  • Publication of the application:
    • Black and white: 146 RON.
    • Color: 487 RON.
  • Examination of the request:
    • Black and white: 536 RON (for one class of products/services).
    • Color: 925 RON (for one class of products/services).
    • Each additional class: 243 RON.
  • Issuance of the Certificate: 243 RON.
  • Renewal of the trademark:
    • Black and white: 584 RON.
    • Color: 974 RON.
